1. Introduction
Welcome to Kitchar ("we," "us," "our"). By accessing or purchasing from kitchar.in ("the Site"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our Site or purchase our products.
2. Products
We make every effort to display our products, including colors, dimensions, and descriptions, as accurately as possible. However, we do not guarantee that product images, descriptions, or other content on the Site are completely accurate, current, or error-free. Minor variations in color or appearance may occur due to photography or display settings.
3. Orders and Payment
We accept payments via Cash on Delivery (COD) and prepaid methods (UPI, Debit Card, Credit Card) processed securely through Razorpay. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or unavailability of stock. In such cases, any prepaid amount will be refunded in full.
4. Product Use and Liability
Our products are intended for their stated purpose only (e.g., food storage). We are not liable for any damage, injury, or loss resulting from:
Misuse, improper handling, or use inconsistent with product instructions
Modifications made to the product by the customer
Normal wear and tear over time
To the maximum extent permitted by law, Kitchar shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products.
5. Returns and Refunds
All returns and refunds are governed by our separate Return & Refund Policy, available on our website.
6. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, and product photography, is the property of Kitchar and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this Site without our prior written consent.
7. Pricing Errors
While we strive for accuracy, pricing errors may occasionally occur. If a product's correct price is higher than the price stated on our Site, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of the cancellation.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Kitchar's total liability arising from any order shall not exceed the amount paid by the customer for that order.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India, and any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Kerala, India.
10. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time without prior notice. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
